Garden Timer: Focus & Grow
These Terms of Use ("Terms") govern your use of the Garden Timer application ("the App") for iOS, developed by an independent developer ("we," "us," or "our"). By downloading, installing, or using Garden Timer, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Garden Timer is a focus timer application designed to help you stay productive while growing a beautiful virtual garden. The App is licensed, not sold, to you for use strictly in accordance with these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Garden Timer on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.
This license does not allow you to:
The license granted to you is limited to a non-transferable license to use Garden Timer on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You may use the App on devices connected to your Apple ID through Family Sharing, subject to any restrictions set forth in these Terms and Apple's Usage Rules.
We are solely responsible for providing any maintenance and support services for Garden Timer, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

GARDEN TIMER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You assume full responsibility for any costs associated with any necessary servicing or repairs of any equipment you use in connection with the App.
We, not Apple, are responsible for addressing any claims you or any third party may have relating to Garden Timer or your possession and/or use of the App, including but not limited to:
In the event of any third-party claim that Garden Timer or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
All intellectual property rights in the App, including but not limited to graphics, user interface, audio content, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You must comply with applicable third-party terms of agreement when using Garden Timer. For example, if you use the App over a Wi-Fi connection, you must not be in violation of your wireless data service agreement.

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Garden Timer offers optional premium features ("Garden Pro") available through in-app subscription. Subscription options include:
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. Subscription fees are charged to your Apple ID at confirmation of purchase.
If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription. You will not be charged during the free trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.
You can manage or cancel your subscription at any time through your Apple ID account settings:

All purchases are processed by Apple. Refund requests must be submitted through Apple at reportaproblem.apple.com. We cannot process refunds directly.
